Welcome to The Q&A with Elaine Moore. Dearest Elaine,
Thank you again so much, we are very very grateful for your eduational site, you are changing lives out here!
Now for my question, this is on behalf of a friend and co-worker who is struggling with HypoT, (she writes you too, but I am going ahead to ask this for both of us) -
her doctor has not been cooperative about taking her FT3, FT4 and TSH when she tells him she is not feeling well, and that she wishes to see her blood counts (so she can see what's goin' on.)
So my question is, does a patient have the right to demand a FT3, FT4 and THS blood test, even if the doctor doesn't want to ? And if the doctor won't comply with the patient's request to get labwork, is there any legal recourse the patient can take to challenge his refusal, (versus having to go to the time and trouble to find a new doctor) ?

Hi JES,
Your friend does have a right to get copies of all her lab results and other medical records except for psychiatric notes. This is a provision of HIPAA and a physician who doesn't comply can be reported.
Doctors are sometimes limited by insurance providers, HMO groups, etc. as to what tests they can order. Approved tests are based on diagnostic codes and the guidelines follow the ones designed by medicare/medicaid services. It's set up to discourage laboratory panels and screening tests. But once someone has a diagnosis, they should be approved for FT4, FT3 and TSH tests. But if a doctor is in an HMO group that covers labs, ordering too many labs may be frowned upon. This may not be the case. It could be that this doctor is just stubborn or doesn't understand the limitations of the TSH test.
Unless you're in NY, NJ, or RI, you can always have direct access testing performed through my lab testing or healthcheck USA. Some patients do this and then show their doctors how meaningful the results are. Best, Elaine
